leadership, said Friday the Senate should not confirm another U.S.
Supreme Court nominee under President Bush “except in extraordinary
circumstances.”
“We should reverse the presumption of confirmation,” Schumer told the
American Constitution Society convention in Washington. “The Supreme
Court is dangerously out of balance. We cannot afford to see Justice
Stevens replaced by another Roberts, or Justice Ginsburg by another

Suppose Stewart or Ginsburg, who has cancer issues, kicked the bucket today, god
forbid, and Chuckles made good on his threat
to deny Bush an appointment. We'd have is a 5-3 court, at worst.
That's 5 Americans v. 2 leftwing reprobates, and a wishy-wash Kennedy. If that happened I'd hope the court would hear every
lightning rod case on the books next term.. Roe, the Commerce
Clause, McCain-Feingold, Environment, OSHA, private probperty, prayer in school, state anti-gun laws ... all of
them. I like the odds.

ReplyDeleteIf Congress would just do its job and pass strong legislation, this wouldn't be an issue. Instead, they leave it for the courts to decide the issues of the day.
ReplyDeleteThis turns the judiciary into an unelected "sub-legislature" (I just made up that word, but it says what I mean). This is why judicial appointments have gotten so political lately.
The solution is for us, the citizens, to hold our elected representatives' feet to the fire and make them pass strong laws again. Unfortunately, that's not going to happen. We're too busy watching "Just For Laughs".
