The internet chapter of the Anti-Counterfeiting Trade Agreement, a
secret copyright treaty whose text Obama's administration refused to
disclose due to "national security" concerns, has leaked. It's bad. It
says:
- * That ISPs have to proactively police copyright on
user-contributed material. This means that it will be impossible to run
a service like Flickr or YouTube or Blogger, since hiring enough
lawyers to ensure that the mountain of material uploaded every second
isn't infringing will exceed any hope of profitability.
- * That ISPs have to cut off the Internet access of
accused copyright infringers or face liability. This means that your
entire family could be denied to the internet -- and hence to civic
participation, health information, education, communications, and their
means of earning a living -- if one member is accused of copyright
infringement, without access to a trial or counsel.
- * That the whole world must adopt US-style
"notice-and-takedown" rules that require ISPs to remove any material
that is accused -- again, without evidence or trial -- of infringing
copyright. This has proved a disaster in the US and other countries,
where it provides an easy means of censoring material, just by accusing
it of infringing copyright.
- * Mandatory prohibitions on breaking DRM, even if doing
so for a lawful purpose (e.g., to make a work available to disabled
people; for archival preservation; because you own the copyrighted work
that is locked up with DRM)

UPDATES:
This whole thing is bizarre enough, and Huff Post
just made it more so by claiming " The Administration is bowing to
demands from a handful of corporations to keep the public in the
dark." That's right. The Chamber of Commerce is making Obama do it.

Because the text
of the treaty and relevant discussion documents
remain secret, the public has no way of assessing whether and to what
extent these and related concerns are merited," the groups said in a
letter (.pdf) to trade representatives from the participating nations. |

I've been otherwise engaged today; Ro just called to tell me to read the comment on the last post. This can't be real? No even this prick would be so bold, would he? So far haven't found a mention of it, let alone verification. I'm sure that will change.

Some more commentary from Wired Magazine. Being in that publication, methinks it's for real, and I wouildn't put anything past our Megalomaniac Man-child in Chief and his thugocracy to gain control of anything and everything they can. Uhbama doesn't give a shit about stolen profits; he wants to restrict the things that are hindering his conquest; e.g., internet communications.

All treaties into which the United States of America wishes to enter must be approved by a vote of the U.S. Congress. Zippy cannot just arbitrarily do this on his own! He claims to be a constitutional lawyer (I somehow doubt the claim) but surely a near-idiot would know better than this crap, wouldn't he?
