ReplyDeleteThe person in question had a sub-50 IQ, and the judge was asked if he was smart enough to be able to provide adult consent to have sex.
If you are mentally disabled to the point of needing a guardian, then informed adult consent may not be possible.

I hate to advocate limiting someones freedom, but the real question is can this person take care of and support the result of 'having sex'?

I don't think this is a hard case making a bad law.

Regardless of his chronological age, he is a child.
And you can't have sex with a child. Unless you are another child, a serious crime is being committed.
The crime is on the behalf of the adult, not the victim. I don't care if he enjoys it. An two year old may enjoy it if you give him beer in his bottle. That does not matter.
