The CNN story interested me, I followed some links and found the Judge's ruling. I also found the Snopes report which claims that the story is false. The story is not false.
The ruling was not a judgment, it was denying CNN's motion to dismiss. The Judge made quite a few findings in the order, i.e., "The Court finds these allegations sufficient to establish that CNN was acting recklessly with regard to the accuracy of its reporting, i.e., with "actual malice."
also... CNN reported that Florida's Agency for Health Care Administration had opened an investigation as a result of its reporting. The court found... "Quite to the contrary, Plaintiff alleges that AHCA issued a public statement "setting ther record" as to CNN's assertions ... that it was "not investigating. Nevertheless, CNN allegedly continued reporting that an investigation was on-going."
CNN countered that the Fair Report Privilege should protect it. The Court stated "Given that there was allegedly no such investigation, it would be difficult to apply a privilege to a non-existent proceeding."
The Court also found that "actual malice ... as evidenced by CNN's continued publication about an official investigation when the AHCA had affirmatively stated that none existed , generally overrules the privilege."
Snopes is full of sh*t, and so is CNN. I'll bet that CNN settles this case confidentially, with a gag order.
