This might be the most assanine thing to ever come out of the Ninth Circuit (I shouldn't say that, they'll try to top it).
When did a particular job become an inalienable right? The employer, even the government, sets the terms and conditions of employment. Considering what the folks at JPL have access to, and considering that security there is already a seive, this seems reasonable to me.
I go through a complete background check, including polygraph exam, every five years, heck the guys who empty our trash and dust go through background checks.
I think a more relevant question is who did the backgrounds on judges in the Ninth?

Background checks on circuit court appointments are done by the President and Senators that confirm the appointments.
