COLB - Berg Loses

Berg Lawsuit Dismissed

As expected, Judge Surrick has reportedly dismissed the lawsuit brought by Philip J. Berg against Obama, the DNC, and the FEC. According to the Saturday morning on-line edition of The Philadelphia Daily News, Judge Surrick dismissed the case brought by Philip J. Berg:

In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.

Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”

The judge also said the harm Berg alleged did “not constitute an injury in fact” and Berg’s arguments to the contrary “ventured into the unreasonable.”

There is a bit of delicious  irony here.  Philip Berg, of course, is a noted supporter of Hillary Clinton.  Guess who put Judge R. Barclay Surrick on the federal bench?   One thing I don't get, so help me here.  Why did the DNC, Obama. et al, refuse to voluntarily produce what Berg wanted to see, and end it both legally, and black-cloud wise?

1. Obama's "vault" version (certified copy of his "original" long version) birth certificate; and
2. a certified copy of Obama's Certificate of Citizenship;
3. a certified copy of Obama's oath of allegiance."

Never could understand that.  Unless ... .

I'm not nearly as disappointed by this ruling as I am alarmed (yes, even more alarmed) by the "bodyguard of silence" imposed on the entire issue.

A question for you legal eagles out there: If voters don't have standing, who does have standing to demand this verification of natural born citizenship?

I can understand misapprehension about the success of any investigation into the cipher that is Obama's roots, but for the life of me I cannot understand the pharisaical redress directed at anyone who sees an ocean of discrepancies in the official Obama resume, let alone an utter lack of curiosity. And I include Charles Football. Sheesh.

Handled right, the Fed District Court throwing out Berg for lack of standing can present a political check-mate “win” on appeal for the anti-Obama side (if not in law, in the Court of Public Opinion). Here’s how: SIMPLY SPREAD AROUND OBAMA’S APPELLATE BRIEF HAVING TO ARGUE AGAINST AN AMERICAN VOTER’S RIGHT TO RAISE THE QUESTION UNDER THE CONSTITUTION. Should be a PR disaster for the Dems and Obama!!!

What was at stake here was something that would force the media to mention the damned thing. Nobody - I said NOBODY who isn't married to me is aware of this controversy. Why do you think the media have been silent about it? It's a net loss for the Kenyan wetback, no matter what, if it breaks public wind, and the Donks know it. Why do you think Why did they make a preemptive stink about McCain's citizenship?

I would expect that Judge R. Barclay Surrick will now become a statistic on the Clinton list of mysteriously departed connections, or he will suddenly retire to a villa in Mombassa. Either way, an appeal is called for by Mr. Berg before Baram Obaka (or whatever his name is) declares Marshall Law.
