Need one vote to bring Obama to court

Turncoat  Conservative Justice?
One vote blocking Obama Citizenship hearing by Supremes.


This is very interesting.  During an "open mic" session in California, Justice Scalia was asked a procedural question about how the Obama citizen eligibility question could get before  the SCOTUS. 

Scalia stated that it would be heard if I can get four people to hear it. He repeated, you need four for the argument. I got a feeling that he was saying that one of these four that call themselves constitutionalists went to the other side," Taitz said.

He did not say that it is a political question, he did not say that it is for the legislature to decide. For example, right after me another attorney has asked him about his case of taxing some Internet commerce and right away Scalia told him that he should address it with the legislature. He did not say it to me. He did not say that Quo Warranto is antiquated or not appropriate. No, just get four," she said. - Full story, definitely worth reading.

  While at least four  requests have been heard "in conference" by the justices (Taitz, Philip Berg, Cort Wrotnowski and Leo Donofrio), no hearings have resulted on the evidence.  The affirmative vote from four justices is needed before a hearing on the merits can be scheduled.
Conservative judges are Chief Justice John Roberts, Justice Samuel Alito, Scalia and Justice Clarence Thomas.  So which one of those four has been blocking it? It's not Scalia.

It's Roberts. He was the winning attorney for Gonzaga in Gonzaga University v. Doe.

Doe sued Gonzaga because the university violated his rights to confidentiality. His case was dismissed on the grounds that he didn't have standing to sue the university under the Family Educational Rights and Privacy Act of 1974.

The reason that case is important is that Gonzaga is the case continually cited for the propositon that these various petitioners do not have standing to challenge BHO's qualifications for the U.S. Presidency.

Roberts doesn't want to tarnish his hard-fought victory in Gonzaga.

I don't know about what Chuck said, it sounds solid. But I have a feeling it's Roberts too. For no real reason, either. He just seems the most likely of the four.

Hey..That picture...Wasn't that Barry, LeRoi, and Njhoni back when they ran that "help me retrieve my inheritence money" operation over the computer?...Man, those were the days..I think they musta made 12-13 dollars outta that deal....Used the money to corner the 'gorilla feet ashtray' market, I understand.

As I recall, Orly said in January that Roberts was hinting there "was something wrong with this election".

Also, a commenter at The Right Side of Life says she contacted the LATimes reporter who covered Scalia's appearance. The reporter emailed her back with a different version of the story.

Who to believe?
