So once again, nothing is based on merit of the case. Everyone can get a little something no matter if your case is valid or not. So if Johnny is diagnosed with ADD, they can go back and sue the doctor who delivered him because he used the salad tongs, and 16 years later is a little prick with no parental discipline. Similarly, the guy who gets a double by-pass, and they do the wrong side of the heart, well he is seen by the law just like our hero Johnny. There is no punative effect against incompetence. Either way, the number of cases against the medical community is not decreased, keeping lawyers like Barry and Mitch employed.
Hey, what if there was a medical review board that would judge your case to be without merit. Then, if you want to go ahead and sue, fine, but if you loose you get to pay all involved expenses. That would have lawyers selling pencils on the street (in between passing ambulances).
