If anyone thinks Mayor Daley will abide by the law, you need to pick up an aviation rag and read about him personally driving the dozer that started the destruction of Meigs field, a Federal Property. The man is above the law. -Plowboy

Isn't the disturbing part of the arguments that will take place come on the issue of incorporation?

And if so, doesn't it create a threat to the Tenth Amendment?

Does it require incorporation in order to have federally established constitutionally recognized rights enforced within the jurisdictions of state and local governments? And, is the willingness to go the incorporation route tend to create greater risks of federal intrusion than a simpler route?
