Christie's BIG Test

In New Jersey, residents who want to transport firearms legally must request a permit from a local law enforcement office and produce a letter stating why it is necessary for them to carry a gun.  In other words, New Jerseyans have to prove need before exercising what many Americans consider a constitutional right.

Listen up Gov. Christie

I am flabbergasted by this New Jersey law,  but even  more so that Brian Aitken was convicted (sentenced in August to seven years in prison).  That means not one of twelve jurors would exercise jury nullification of this outrageously unconstitutional law.  NOT ONE!  The ball is in Gov. Christie's court now.  Will he pardon Aitken?  Or, like George Bush with Border Patrol Agents Ignacio Ramos and Jose Compean, let him languish in prison?  I am a huge Christie fan, but  if he drops the ball on this -- he will become for me just another Mitt Romney (fatally flawed).  Your values may differ.

Mt $0.02 after reading details about this guy: The judge in my opinion is a hardcore anti-RTBA radical. I run into these people often. They hold in contempt ANYONE who owns firearms. This judge did everything possible to make sure this poor guy got convicted.

NJ resident here. I have gone through the background checks.. twice. I had to go through a second time when I moved from Hoboken to Jersey City. While a Hoboken resident, I had to threaten a lawsuit because the police chief there only signed permits for his friends. He would "ignore" the rest.

Jersey City won't call you to tell you the application process is complete. If you miss a window where you come down to pick up your purchase permit.. you lose it. You have to keep calling every day for weeks to find out if your permit is ready.

That's why I left that damn state. I really wish I could have been on the jury of a case like this when I did live there, though. I would have had no problem putting jury nullification into practice. In fact, I would have nullified any gun case unless other real crimes were also committed.

I am assuming that this case is under appeal, and the Appellate Division should overturn the trial court verdict, if for no other reason than the judge apparently refused to honor the jury's request for information concerning the exception in the law for changing residences.

That said, New Jersey's gun laws are Byzantine at best and asinine at worst. Being granted a permit to purchase a handgun must be approved by, among others, the local police chief. They can (and often do) sit on these for arbitrary reasons or in response to some personal animus for the applicant.

Permit to carry? Forget it. The law provides that you can get one "for good cause shown." I know of no one who has been able to show the elusive "good cause." Perhaps surviving three hit attempts by organized crime figures might work.

Of course, you can buy all the guns you want on the streets of democrat strongholds such as Newark and Camden.

I'm hoping this case will lead to some changes in NJ gun laws. Yes, that judge was a rabid anti that refused to let the defense admit some good evidence because it was "not relevant" or site Federal law that overrules local laws on firearm transport. I doubt the poor guy will serve the sentence, it _should_ be an easy win on appeal. Never can tell in NJ, tho.

Glad I live in Texas. I've had a concealed carry permit since they were allowed back in 1996.

We also have the "Castle Doctrine", in that (under most circumstances) we are not required to retreat from intruders when threatened in our homes or vehicles. Deadly force may be applied when the threat is judged to be sufficient to fear for one's life.

I'm glad I live in a state where we don't have to get Permission from our government to carry discretely or in the open.
The guy moved from Colorado to NJ- what did he expect???
