Another Judge Nixes Obamacare

I fully expected to see Obama quoted, "Thank God for Reagan and Judge Vinson."  Didn't find that quote.  Yet.

Best part is that he ruled that the individual mandate is NOT severable; therefore the whole law is unconstitutional. Yesssss!

Yesssss, there are a couple of other time bombs in the Judges ruling. While the Obombanites can appeal to the Supreme Court they run the risk of the Supremes deciding to hear an appeal. Also if the agree to hear the appeal it is liable to be in 2012 and it is 50/50 on how the court would rule.
Meanwhile back a the ranch the drumbeat of bad publicity on all those health care waivers for unions continues. Demint say's he has all 47 of the Republican senators on board to present the repeal Obamacare bill to the Senate. Thigs are getting more and more sweaty for the Dims as regards the 2012 elections. Not looking to good for the RINO's either. I like that bill in comittee that is saying that Congress can't excempt it self form laws it requires everyone else to follow.

Unconstitutional or not, you can bet that Kathleen Sibelius is building the bureaucratic infrastructure as fast as she can. The Socialist Democrat Party is counting on the inability to remove this cancer when Obamacare is overturned. What is really needed is an injunction that stops further implementation while the constitutionality of Obamacare awaits the Supreme Court decision. - Skyhawker, Doug

From the ruling:
"5) Injunction
The last issue to be resolved is the plaintiffs’ request for injunctive relief joining implementation of the Act, which can be disposed of very quickly. Injunctive relief is an “extraordinary” and “drastic” remedy. It is even more so when the party to be enjoined is the federal government, for there is a long-standing presumption “that officials of the Executive Branch will adhere to the law as declared by the court. As a result, the declaratory judgment is the functional equivalent of an injunction.”
