Oh, look! A liberal is talking ... .

Oh, look! A liberal is talking about whether something can be "squared with the Constitution."

... here's Ian Millhiser at Think Progress writing under the headline 'The Eleventh Circuit’s Affordable Care Act Decision Cannot Be Squared With The Constitution.'

He proceeds to quote the text of the Commerce Clause. (Of course, he doesn't stop there, but goes on to claim that there's virtually no limit to what Congress can do in the name of regulating commerce as long as "it does not violate another textual provision of the Constitution." Note the use of the word "textual," as if he would limit those other constraints to what is written in particular text. The obvious hypo: Could Congress ban abortion using its commerce power? Millhiser? Millhiser? Millhiser? Millhiser?)  [Full Ann Althouse]

I love the petard thing.  H/T comments.

And strangely we don't hunt them like deer.

Dumbass.

The Bill of rights and the anti-slavery amendments trump the commerce clause, as do any other amendments.

Deer taste good.

Liberals are stringy, chewy and have a distinct stupid flavor about them.

Also, deer are quick, aware of their surroundings, elusive prey that are fun and challenging to hunt.

Liberals - not so much. They just stand there wide eyed screaming at the world. Where's the challenge in that shot?

Well David its just that even when you get a head shot they still walk around spouting the same crap...
Now I do agree the deer is a much more noble prey to serve your carnivorous friends it proves that you are an accomplished hunter but sometimes meat is meat.

The equivalence between liberals and deer is a false one. Liberals are vermin. Deer are...

So, every power is permitted to the FedGov unless specifically prohibited elsewhere in the Constitution, eh?
Wellp ... that's a direct inversion of the Tenth Amendment which says that every power is prohibited to the FedGov unless specifically permitted elsewhere in the Constitution.
Howzat for a "textual provision," you arrogant jackass?

If the states do it, the feds don't get to. That is all.
