Res Ipsa LoquitorAllowing the question of Obama's identity to slide easily into the night unanswered would be another admission that we the governed have no power over our governors.  An admission that the Alinsky gambit of ridiculing dissent  into silence is a legitimate tool in our national debate. The Constitution doesn’t define “natural born”, but according to common law at the time and, later, the 1875 U.S. Supreme Court case “Minor v. Happersett”, a “natural born” citizen is understood to be someone born in the U.S. to citizen parents (plural). “Minor” spelled out this definition and is thus the signal case.

It is remarkable that in mid-2008, as Barack Obama was clinching the presidential nomination, references to the “Minor” case inexplicably disappeared from 25 related U.S. Supreme Court decisions archived at Justia.com, a leading legal search engine popular with journalists and legal bloggers. Coincidence? When attorney and blogger Leo Donofrio, whose Obama eligibility challenge went all the way to the U.S. Supreme Court in December 2008 (dismissed), discovered this apparent tampering in 2011, Justia called it a “programming error”. If I had the chance, my sole question to question to Romney would be, "If evidence exists that Obama committed felonies while in office or seeking office, will you prosecute?" If his answer required more than one word, I would start preparing my move to Iceland. Which may or may not be in the works regardless.

For the record, Chester Arthur served as President and (i) his father was not an American citizen at the time of his birth and (ii) he may well have been born in Canada.

Andrew Jackson was probably not born in a cabin near Lancaster, SC. He was most likely born at sea on a ship bound from Ireland to Pennsylvania.

The point is, or ought to be, that questions have been raised about Obama's claims, and he has responded with obfuscation, issuing phony documents, and spending millions on lawyers to avoid answering them. I don't believe there's any record of Jackson or Chester Arthur being challenged, so there is no ruling and so quite moot.

It's the cover-up that will get you impeached.
