As he stood in line in the cafeteria, a teacher ordered him to either change shirts or turn it inside out. Marcum declined and was sent to the office, where an officer was dispatched after he again refused to comply with the school’s request. Cops arrested him and charged him with disrupting the educational process and obstructing an officer. The National Review's CORNER account states "One can understand this sort of silliness across the border in Maryland (as we have chronicled here and here).  The citations are for a local boy who was suspended for biting a pastry into the shape of a gun; and another " who was suspended from his school for the high crime of biting a pop tart into the shape of a firearm.” Charles Cooke surmised in the pizza gun story that the NRA (which gave the boy a lifetime NRA membership) "would have spent its time and money far more profitably had it conducted a dogged campaign to hound out of public service whomever thought it appropriate to punish a small child for making pastry shapes."
