IRS

“

According to the Wall Street Journal, the Internal Revenue Service used its power to attack pro-Israel groups.  While the WSJ article is (free for you) subscriber only, here is the gist of it.

Not only did the IRS target politically conservative groups, they also sought to deny tax exempt authorizations to groups who, quoting the Wall Street Journal, “whose missions might conflict with Administration policies.  The IRS’s ‘Be on the Lookout’ list that November [2010] also included red flags for groups referring to ‘disputed territories.’”

The Journal goes on to report that Jewish groups seeking normal tax exempt status received questionnaires with ideologically oriented questions that are eerily familiar in their nature to the types of political inquiries made to tea party applicants.

According to the publication, “one questionnaire we’ve seen from the IRS to another Jewish group applying for tax-exempt status asked, ‘Does your organization support the existence of the land of Israel?’ and ‘Describe your organization’s religious belief system toward the land of Israel.’”

Now that we know that the IRS engaged in litmus testing of applicants based upon their support of Israel’s right to exist as a pre-determiner on whether a Jewish group should have received 501 (c) status, the Obama Administration can no longer cling to the notion that they were merely focusing upon conservative political groups.
The bald and ugly truth is that Obama’s IRS was being used for political purposes before even the Supreme Court Citizens United decision, and before the term “tea party group” was even included in the agency’s black list. As the Journal reports, “emails uncovered by the House Ways and Means Committee show that the IRS and State Department were conferring in 2009 about pro-Israel groups like Z Street and considering arguments to deny their tax-exempt applications.”
This disclosure should frighten every American as it is evidence that...

The news is even worse for Lerner personally, whose pension would be defunded under the House passed legislation so long as she remains in contempt of Congress.

Court to hear IRS challenge

                                                                                      Judges

Supremes docket income tax challenge
Colorado man's challenge to IRS says wages don't count

“
Res Ipsa Loquitor

The government calls those who argue the income tax has no legal foundation “tax protesters” and labels their arguments “frivolous.” And usually judges toss their arguments out of court, assess them court costs on top of taxes, interest and penalties, and sometimes even threaten them if they file further cases.

But now the U.S. Supreme Court – the nine judges who sit on the bench in Washington by virtue of their selection by presidents and confirmation by the U.S. Senate – has docketed exactly that type of case.

Maehr wrote in his petition for judicial review that he’s been the victim of administrative bludgeoning used by the IRS to quell citizens with objections as well as questions.
[...]

Among Maehr’s contentions is that while the government has the legal authority to tax, the Internal Revenue Service has used “unlawful, unconstitutional, unfair and biased” manipulations to assess income taxes on that which is not income – essentially salaries and wages.

Basing his argument on 10 years’ worth of research into tax law, he concludes that salaries and wages are the result of the mutual agreement among participants to exchange labor for money – and that’s not income. Income, he said, is the increased value of an asset, such as interest on money in a bank account, which can be subjected to income tax. [Full]

Regardless of the merit of this, or any case for that matter (I direct you to Obamacare), American law is driven by the necessity of keeping bloated government afloat; law and principle be damned.  Besides. Obama evidently knows where Chief Justice Robert's kids go to school.  Still, Maehr is a true & principled American hero in my book.

USING THE IRS CLUB

Is the IRS Attempting to Intimidate Local Tea Parties?

“
“ An official with the Internal Revenue Service has admitted that legal opponents of former President Bill Clinton were singled out for tax audits, according to court documents made public this week.

"What do you expect when you sue the president?" senior IRS official Paul Breslan told Judicial Watch, the Washington-based legal watchdog group that had filed 50-plus legal actions against the Clinton administration and subsequently found itself in the IRS's cross hairs.

What are local Tea Partiers to think with requests like “Please identify your volunteers” or “are there board members or officers who have run or will run for office (including relatives)”? What possible reason would the IRS have for Tea Parties to “name your donors” when said donations are non-deductible? These are just a few of the questions asked by the IRS in these letters, and one cannot help but suspect an intrinsic threat encompassing all these demands.

The other question is the timing of these IRS letters requesting reams of copies and hundreds of hours of work and potentially thousands of dollars in accounting/legal fees (all due in two weeks). Some of these Tea Party groups have not received anything concerning their nonprofit status since 2010 prior to these letters.

These documents are further undermined by a letter sent to the IRS Commissioner Shulman. Signed by six Senators, it requests that the commissioner investigate 501(c)(4) groups to determine whether they are engaging in substantial campaign activity, including opposition to any candidate. Who signed this letter? Senators Schumer, Franken, Udall, Shaheen, Whitehouse, Merkley and Bennet — all Democrats.

Using the Clinton example, we have good reason to belive that there will never be an official finding agaist Obama, or any Democrat president, for using the IRS to smother critics.  The question then becomes, "Do you think President Obama would use the IRS as a weapon?"  There you have it.  A filter for separating people with brains from the chaff.  Best we can do, I'm afraid.

As an aside

“ ALTHOUGH NIXON WAS notorious for treating the I.R.S. as though it were his private domain, the records show that Franklin Delano Roosevelt may have set the stage for the use of the tax agency for political purposes by most subsequent Presidents. [MISUSE OF THE I.R.S.: THE ABUSE OF POWER- NYT 1989] ”

Nixon was "notorious" only because he was singled out for doing what his predecessors did without rebuke. You may want to read the cited article in the event you don't understand the threat the IRS poses to us all.  Even congress is afraid to curb the the agency's power.

Investment Tip - Let the IRS Errantly Seize Your Money

bits & pieces
Today's Investment Tip

After a several year's long battle with the IRS, during which time they raided our bank accounts, jeopardized our credit rating, and unleashed the state on us ( looking for its share of the spoils), we finally won last year.  Yes, we got our money back. We also got a check for the  interest on the held funds (about 4% ).  So there you have it.  The best (relatively safe) return on your money today comes from getting the Feds to errantly seize your money, keep it for some time before proving they erred, and get the bonus money.  How's that for cups half filled?   Unfortunately the state was more recalcitrant.  They forked over, but no interest from them,  and no notice in the newspaper that they erred by (publicly) placing a lien.  But still ... .

You're welcome.
