Clause 1
The executive Power shall be vested in a
President of the United States
of America. He shall hold his Office during the Term of four Years,
and, together with the Vice President, chosen for the same Term, be
elected, as follows

Technically,
these regulations and executive decrees are not “laws” — but they might
as well be. Over the past century, Congress has granted so much power
to the regulatory agencies that the executive branch, not Congress, now
writes the majority of new federal rules, averaging about 70,000 pages
of regulations per year. But in a last minute orgy, Clinton’s
administration is scheduled to issue about 29,000 pages of new
regulations made just in the last three months of his term.

In
a nation of
315,165,272 people there must be at least 200,000 who are not
lawyers,
and
I'm one of them. Which is why I cannot do the mental
gymnastics necessary to find where presidents find the power to
legislate via the Executive Order. Maybe it's in the same box
where
the courts discovered theirs?
Up until Abraham
Lincoln
(3), there were few if any orders by Presidents
that would classify as legislation.
The biggest leap in EO use came
from
Teddy Roosevelt. Before his presidency there had been a TOTAL 158 uses
of the EO.
T.R. issued 1,006! Wilson had 1,791;
FDR 3,723 (over 12+ years and a World War).
It's
not really the
number of Ex-Orders issued, although to me they're all extra
constitutional, and outside of the framer's intent. It's the
degree of maliciousness that really counts. For instance, Bill
Clinton actually issued 364 E.O., but they actually numbered in the
thousands, thanks to what regulatory agencies did
with them.
Coal-Gate was one of his most outrageous.

When the president signed the Executive Order designating 1.7 million
acres of land in southwest Utah as the Grand Staircase-Escalante
National Monument, his action placed the area off limits to mineral
extraction and development.
The New York Times reported that the monument encloses the largest coal
field in the nation, the Kaiparowitz Plateau, which contains at least 7
billion tons of coal worth over $1 TRILLION.

He did this without even
mentioning it to
any of Utah's congressional delegation. The primary
beneficiary? The
Lippo Group, which Clinton was highly indebted to. Stroke of the
Pen!
Obama has been testing
what he could get away with since he took office. Stopping the
deportation of illegals, which
directly contravene US law, is impeachable. Now, finally, it appears he
may be thwarted
by threatening to Executive Order the Second Amendment into the trash
bin. But he won't give up. Obamacare give Democrats the
ability to
tax anything, or designate anything health
hazard.
What's really scary is
how congress has gone belly-up to this usurpation of their power.
Traditionally congress goes bat-shat over any Executive Branch
meddling, but not now. Not by the Senate, especially. Both
Harry Reid and Nancy Pelosi have urged Obama to use E.O/ powers to get
what they cannot pass legislatively. That's how evil they, and
their intentions are. And what makes me believe that Obama was "
purpose built."
