Report Questions Constitutionality of Giving D.C. a Vote

The research arm of Congress says that legislation to give the District a vote in the House of Representatives is probably unconstitutional, a finding that could jeopardize its chances of passage, officials and analysts said yesterday.

The report lands at a time when the D.C. voting rights effort has been gaining momentum. The new Democratic majority in the House has vowed to move quickly on such legislation.

Thomas Mann, a congressional scholar at the Brookings Institution, said the report represents "a creature of the Congress . . . saying this doesn't really pass constitutional muster. That has to be taken seriously and will certainly be used by those who oppose it."

Justice Department lawyers concluded in an unpublished opinion earlier this year that the historic D.C. voting rights bill pending in Congress is unconstitutional, according to sources briefed on the issue. But Attorney General Eric H. Holder Jr., who supports the measure, ordered up a second opinion from other lawyers in his department and determined that the legislation would pass muster.


Obama pushes D.C. voting rights bill

WASHINGTON | President Barack Obama urged lawmakers Friday to give the District of Columbia a voting member of Congress.

A bill to give the city just that is expected to be brought for a vote in the House next week. Many advocates for D.C. voting rights believe this year could be their last opportunity in a long time if Democrats lose their majority in Congress in the fall.

Aside: I showed the article's picture to MoSup and asked "who do you think this is?" She didn't know.  It prompted a story about a conversation she recently had with her  friend Gail.  "What is it with plastic surgery these days?" Gail asked. "Every page of (some magazine) has an ad for a plastic surgeon."  MoSup responded, "The more you don't take care of yourself on the inside, the more you want to alter the outside."   I thought that was a money quote.
