But since you allowed Obama ...

Natural Born Citizenship: Free and Clear
The concept of natural born Citizenship is clear and concise, to anyone with a rational mind. Although some may wish to contort its meaning to fit the presidential candidate of their choice, natural law is incapable of such bias. It takes two parents to produce a child, one male and one female, but you would never know it if your source of information is the lamestream media. By its logic, only one parent is sufficient.

I just ran across Larry Walker Jr.'s site, and this piece, although  written pre-election (2016)  smacks me as deliciously informative. Check it out.

OKLAHOMA!

As President Barack Obama has advanced his progressive agenda over the past seven-and-a-half years with coerced help from a kowtowed Congress and ruling by executive fiat when they refused, there has been one state consistently at the forefront of opposition to his destructive efforts.

That state is Oklahoma, and there are plenty of reasons why Obama failed to win even a single county in that state during the 2012 election.

  • As President Barack Obama has advanced his progressive agenda over the past seven-and-a-half years with coerced help from a kowtowed Congress and ruling by executive fiat when they refused, there has been one state consistently at the forefront of opposition to his destructive efforts.

That state is Oklahoma, and there are plenty of reasons why Obama failed to win even a single county in that state during the 2012 election.

Furthermore, they are one of the few states that has declared themselves to be a sovereign state, meaning they are not necessarily beholden to any of Obama’s lawless and corrupt decrees and executive actions.
Through the actions of the state legislature and governor, Oklahoma has made several moves to stymie the agenda of the Obama administration on such issues as gun control, illegal immigration, and religious liberty, among other things.

As Obama has thrown open the borders to waves of illegal immigration, Oklahoma has cracked down by actually holding criminal illegals in custody until they can be deported, keeping a DNA sample in the process to better identify them if they come back and commit more crimes, and mandating the drivers license test be conducted in the English language only.

Oklahoma has also rejected the Common Core educational standards and accompanying propaganda-filled curriculum and has stood strong against the Obamacare healthcare reform law, not to mention their staunch opposition to the job-killing regulations put forward by the Environmental Protection Agency.

I have to say that, in my memory
—going back to the Clintons,  Oklahoma has been our most stalwart defender of the Constitution.  Speaking of which, does anyone know what's happening with Merrily? I'm almost afraid to ask.

California Steaming

Will California ever thrive again?

The wealthy elite escape the regulatory hell they’ve created for the underclass

Victor Davis Hanson - - Wednesday, July 6, 2016

There was more of the same old, same old California news recently. Some 62 percent of state roads have been rated poor or mediocre. There were more predications of huge cost overruns and yearly losses on high-speed rail — before the first mile of track has been laid. One-third of Bay Area residents were polled as hoping to leave the area soon.

Such pessimism is daily fare, and for good reason.

*****
Grass-roots voter pushbacks are seen as pointless. Progressive state and federal courts have overturned a multitude of reform measures of the last 20 years that had passed with ample majorities.
The basket of California state taxes — sales, income and gasoline — rates among the highest in the United States. Yet California roads and K-12 education rank near the bottom.
After years of drought, California has not built a single new reservoir. Instead, scarce fresh aqueduct water is still being diverted to the sea. Thousands of rural central California homes, in Dust Bowl fashion, have been abandoned due to a sinking aquifer and dry wells.

One in three American welfare recipients resides in California. Almost a quarter of the state population lives below or near the poverty line. Yet the state’s gas and electricity prices are among the nation’s highest. [Full]

Game on?

Yale fail: Ivy leaguers sign 'petition' to repeal First Amendment

The New York Times’s Anti–Second Amendment Hysteria Continues

Last   weekend, to great self-generated fanfare, the New York Times ran its first front-page editorial in 95 years. Its vital subject: The scourge of so-called “assault weapons,” which, the editors contended, must not only be “outlawed for civilian ownership” but confiscated from those who are already in possession of them. By taking this action, they submitted, the United States would “end the gun epidemic” and at long last reclaim “its sense of decency.

“It’s all about individualism and the right to be whatever you want.”

The 14th misunderstanding

On one hand, we have noted legal expert Bill O'Reilly haranguing Donald Trump: "YOU WANT ME TO QUOTE YOU THE AMENDMENT??? IF YOU'RE BORN HERE YOU'RE AN AMERICAN. PERIOD! PERIOD!"

(No, Bill -- there's no period. More like: "comma," to parents born “subject to the jurisdiction” of the United States “and of the state wherein they reside.”) Ann Coulter

Based on the hysterical flailing at Donald Trump -- He's a buffoon! He's a clown! He calls people names! He's too conservative! He's not conservative enough! He won't give details! His details won't work! -- I gather certain Republicans are determined to drive him from the race.

These same Republicans never object to other candidates who lack traditional presidential resumes -- Carly Fiorina, Ben Carson, Newt Gingrich and Herman Cain, to name a few. I'm beginning to suspect it's all about Trump's opposition to mass immigration from the Third World.

Amid the hysteria, Trump is the only one speaking clearly and logically, while his detractors keep making utter asses of themselves.

By my count -- so far -- Fiorina, Chris Christie, Rick Perry and the entire Fox News commentariat are unfamiliar with a period of the nation's history known as "the Civil War." They seem to believe that the post-Civil War amendments were designed to ensure that the children of illegal aliens would be citizens, "anchor babies," who can then bring in the whole family. (You wouldn't want to break up families, would you?)

As FNC's Bill O'Reilly authoritatively informed Donald Trump on Tuesday night: "The 14th Amendment says if you're born here, you're an American!"

I cover anchor babies in about five pages of my book, Adios, America, but apparently Bill O'Reilly and the rest of the scholars on Fox News aren't what we call "readers."

Huh. In 1884, 16 years after the 14th Amendment was ratified, John Elk, who -- as you may have surmised by his name -- was an Indian, had to go to the Supreme Court to argue that he was an American citizen because he was born in the United States.

He lost.

In Elk v. Wilkins, 112 U.S. 94, the Supreme Court ruled that the 14th Amendment did not grant Indians citizenship. [... they obtained citizenship in a law perplexingly titled: "THE INDIAN CITIZENSHIP ACT OF 1924." Yeah, Trump's the idiot.
Still, how could anyone -- even a not-very-bright person -- imagine that granting citizenship to the children of illegal aliens is actually in our Constitution? I know the country was exuberant after the war, but I really don't think our plate was so clear that Americans were consumed with passing a constitutional amendment to make illegal aliens' kids citizens.

Put differently: Give me a scenario -- just one scenario -- where guaranteeing the citizenship of children born to illegals would be important to Americans in 1868. You can make it up. It doesn't have to be a true scenario. Any scenario!

You know what's really bothering me? If someone comes into the country illegally and has a kid, that kid should be an American citizen!

Damn straight they should!

We've got to codify that.

DC GUN CONTROL CAVE, and an imposter

“
The U.S. House this week removed a provision approved earlier this year that would have blocked funding for Washington, D.C.’s strict gun laws.

The amendment, originally passed by a voice vote in the Republican-controlled chamber in July, was proposed by Rep. Thomas Massie, R-Ky., to H.R.5016, a House appropriations act that funds the District in 2015. However, Republican lawmakers introduced a ‘clean’ bill to Capitol Hill late Tuesday without the rider prohibiting funding for gun control measures.

“Yesterday’s victory was an important step in our efforts to protect the District’s right to self-government,” the District’s nonvoting Democratic Rep. Eleanor Holmes Norton said in a statement Wednesday, taking credit for the win in knocking off riders to the continuing resolution which not only included Massie’s funding cut for gun control measures but also one forbidding D.C. from spending money on a legal marijuana program.

TWO THINGS:
1) Re: the vote by a Republican controlled House - Do I have to say it?  I thought not.

2) EHN has no more right to a seat in congress than does a Guadalajaran prostitute.  She lives in the District of Columbia, which was expressly denied the right of representation by the United States Constitution.  So, what do Democrats do when the Rule of Law gets in their way?  They make shit up. She is "an elected" MOC; on the payroll; has the right to  speak on the House floor; she can serve on committees, and she can sponsor legislation.  She just cannot vote on stuff.  Whoop-de-do.

Here's some recent Eleanor Holmes Norton, via Dumbocrat Quotes

Appearing on MSNBC, Eleanor Holmes Norton tried to fan the flames on the Ferguson racial riots.
“Hey, black community! You see what happens when you don't have your own elected officials out there, people who have had experiences similar to your own. I don't understand that. Again, there may be something about the way the elections are conducted in that county. But if I were in that community, the first thing I would be doing is organize voters to go to the polls in November.”
Eleanor Holmes Norton, August 19, 2014

Speaking in Congress, Eleanor Holmes Norton claimed Americans do not have the right to know what's going on in the White House.
“You don't have a right to know everything in a separation-of-powers government, my friend. That is the difference between a parliamentary government and a separation-of-powers government.”
Eleanor Holmes Norton, July 25, 2014 Audio and/or video clip available

Speaking in the House, Eleanor Holmes Norton claimed the Iraq war was more catastrophic than World War I, World War II, and Vietnam.
“And of course in Iraq, clearly one of the unintended consequences surely would have been renewed conflict between the Sunni and Shia, and yet we went in, we went in headfirst, perhaps the most catastrophic war of the 20th century invasion by the United States of America.”

Droning Away Here Boss

TECHNO THRILLS

Wiiiiiiiiiiiii

Wheee!  What a boon to people living under the thumb of cruel dictatorship, wot.  Imagine these in the hands of say North Korean freedom fighters, whose dear leader loves to watch them publicly cow-tow for his pleasure?  Splatt-Paintballed!  Or almost any African continent peoples.  Of course you can be assured that dictatorships are rapidly putting into place the means to more tightly monitor all purchases by the proles.  People not constitutionally protected from their governments with, not only a right to bear arms, but the urging of their Founders to use them against any inevitable government gone-wild.  Thank God that here in the USA we only need use them for recreational purposes, like overflying  nude beaches, or watching Carol Solley get  dressed for cheerleader practice.  No need to worry about Hitlarian tactics here in the. USA!  Someone cue the Beach Boys!

A Burning Question

TODAY'S QUIZ
ROGUE GOVERNMENT

Res Ipsa Loquitor

Here's today's quiz (to which I have no answer).

Our constitution famously created three co-equal branches of government, the better to keep one rogue branch from taking over.  I can cite numerous cases where the legislative branch have trumped an executive branch action, and vice-versa, but for the life of me, I cannot think of a single case where the judicial branch has been quashed .  Can you?  If not, what does that mean (I can answer that).

Let the kids do it

Kids at Play
 K.I.S.S.
“ An abstract for the paper debunks the claim that the president has the Constitutional to not enforce civil laws crafted and passed by Congress.

Res Ipsa Loquitor

“It’s the duties of the president. He must always uphold the law.”

- John Yoo, Berkeley law professor and former State Department attorney

In the paper entitled, “The Obama Administration, the Dream Act and the Take Care Clause,” authors Robert Delahunty of the University of St. Thomas [Minnesota] and John Yoo, a law professor at University of California at Berkeley and former U.S. deputy assistant attorney general, blast Obama's moratorium on deporting certain illegal immigrants. The professors dismissed the idea that the decision on whether to deport illegal immigrants who are arrested for minor infractions is a matter of prosecutorial discretion.

“If there’s one case and it’s left to the prosecutor well that’s fine, but what Obama did was take a million cases and leave it up to prosecutorial discretion, “John Yoo said to FoxNews.com. “The only reason it’s under [Department of Homeland Security Secretary] Janet Napolitano’s discretion is because Obama had made his decision. If she’s doing it under her own, she would have to be fired.” [Full]

Let's say you could take a group of 3rd graders,  and in a flash inculcate their little brains with the full text and meaning of the U.S. Constitution; and an honest history of the United States.  Having done this, we have them read the law professor's argument, and ask— " what should be done?"   The answers would undoubtedly be:
  1. Impeach and remove this President
  2. If the Congress will not impeach and remove the President, remove them.
  3. If they resist, nourish our "Tree of Liberty" with their blood.
  4. Give Free Ice Cream to Everyone*
That's how simple this is.  So where have we gone wrong?

A Short History of Congress's Power to Tax

A Short History of Congress's Power to Tax
The Supreme Court has long distinguished the regulatory from the taxing power.

“
Res Ipsa Loquitor

The first enumerated power that the Constitution grants to Congress is the "power to lay and collect taxes, duties, imposts, and excises, to pay the debts and provide for the common defense and general welfare of the United States."
CLICK FOR VIDEO
The text indicates that the taxing power is not plenary, but can be used only for defined ends and objects—since a comma, not a semicolon, separated the clauses on means (taxes) and ends (debts, defense, welfare).

This punctuation was no small matter. In 1798, Pennsylvania Rep. Albert Gallatin said that fellow Pennsylvania Rep. Gouverneur Morris, chairman of the Committee on Style at the Constitutional Convention, had smuggled in the semicolon in order to make Congress's taxing power limitless, but that the alert Roger Sherman had the comma restored. ...

The punctuation debate simply reinforced James Madison's point in Federalist No. 41 that Congress could tax and spend only for those objects enumerated, primarily in Article I, Section 8 [Continue WSJ]

We are now faced with a new constitutional dilemma, it seems to me.  That is, what if a significant number no longer care about original intent, or even about the constitution itself—except as a cloak of legality where none exists?  What then?
