A recurring thought has been; "If  if Trump "loses" this election, it will be a Pyhrric victory for Democrats and allied GOPers."  Why?  Because, looking at the huge crowds, and unprecedented donations Trump/Pence are seeing, there is no way they lose without balls-out vote manipulation.  They would then be in a position where a majority don't accept a Hillary presidency, and are furious about it. We are an armed country.  Massive civil disobedience—hell, even open rebellion could ensue.  Which, all things considered, would justified. That's what I thought, and still think.  But... there is a decent chance that's exactly what the plan is.  The Helter-Skelter trigger, where martial law is imposed, and constitutional protections (that are still observed) will be kaput.  The United States will look like 1930's Spain or Yugoslavia.

I don't have to comment on this obscenity, not in this forum.  But it did set me to thinking about how freedom of speech, guaranteed by the First Amendment to our Constitution, has eroded.  The very first time my alarm bell went off, as I remember, was reading about what was happening at U. Wisconsin.

1988

 As Chancellor of the University of Wisconsin–Madison. Under her chancellorship and with her support, the University adopted a broad speech code subjecting students to disciplinary action for communications that were perceived as hate speech. That speech code was later found unconstitutional by a federal judge.

Also while chancellor, Shalala supported passage of a revised faculty speech code broadly restricting "harmful" speech in both "noninstructional" and "instructional" settings. The faculty speech code was abolished ten years later, after a number of professors were investigated for alleged or suspected violations.[Wikipedia]

A 1992 (Liberal) Baltimore Sun editorialDonna Shalala's deadly intentions—sounded the alarm.

WITH the United States about to mainline the addictive narcotic of a government-administered health-care system, we should look at the person who will stick that rusty old needle into the bulging vein of our national body politic. Donna Shalala has been nominated to head the $590 billion-per-year Department of Health and Human Services.

In his best-selling book, "Illiberal Education," Dinesh D'Souza detailed the cult of political correctness Ms. Shalala, the chancellor of the University of Wisconsin, has fostered. In place of scholarship and teaching, she demanded "a basic transformation of American higher education in the name of multiculturalism and diversity."

As head of HHS, Ms. Shalala will be deeply involved in the divisive issues of race and sex in America. Yet she has revealed: "I would plead guilty to both racism and sexism. The university is institutionally racist. American society is racist and sexist. Covert racism is just as bad today as overt racism was 30 years ago. . .

Soon she could be in a position to impose her own radical ideas on us. Indeed, her very emphasis on "covert racism" -- what people think -- is tinged with Orwellian overtones of a national Thought Police.

Now, the left have successfully insinuated the new crime of hate speech into the culture.  The Washington Post recently printed Eugene Volokh's "No, there’s no “hate speech” exception to the First Amendment." He allows this distinction.
Indeed, threatening to kill someone because he’s black (or white), or intentionally inciting someone to a likely and immediate attack on someone because he’s Muslim (or Christian or Jewish), can be made a crime. But this isn’t because it’s “hate speech”; it’s because it’s illegal to make true threats and incite imminent crimes against anyone and for any reason, for instance because they are police officers or capitalists or just someone who is sleeping with the speaker’s ex-girlfriend.

Bullshit!   It's a crime already covered by statute. There can be no reason for creating a parallel crime of hate then to allow a subculture to end run the First Amendment.  End of Story. They should be shot.

Judicial Watch has just released a new batch of documents forced out of the IRS that show the Obama administration’s scandalous misuse of the IRS to target Tea Party and other conservatives goes far deeper than realized.

Included in the new batch of documents is a February 2012 email from Lois Lerner, who was then head of the IRS’ Exempt Organizations Branch, asking that a special program be set up to “put together some training points to help [IRS staffers] understand the potential pitfalls” of revealing too much information to
A May 1, 2013, email exchange between Lois Lerner and other top IRS staffers revealed that she met with select top staffers from the Senate Governmental Affairs Committee in a “marathon” meeting to discuss concerns raised by both Sen. Carl Levin (D-MI) and McCain that the IRS was not reining in political advocacy groups in response to the Supreme Court’s Citizens United decision.

Amid the hundreds of released pages, Judicial Watch also found a remarkable Lerner email from 2013 in which she says she is willing to take the blame for not having provided sufficient direction to her underlings on how best to investigate the targeted groups, and then concedes that she “understands why the IRS criteria” leading to targeting of Tea Party groups and other opponents of President Obama “might raise questions.”

In May 2013, the Treasury Inspector General for Tax Administration (TIGTA) released an audit revealing the IRS had used “inappropriate criteria” to identify potential political cases. “Early in Calendar Year 2010,” TIGTA wrote, “the IRS began using inappropriate criteria to identify organizations applying for tax-exempt status to (e.g., lists of past and future donors).” The illegal IRS reviews continued for more than 18 months and, TIGTA reported, “delayed processing of targeted groups’ applications” preparing for the 2012 presidential election.”

Not so coincidentally, during this period of time, Lerner emailed former Director of the Office of Rulings and Agreements Holly Paz, attempting to limit information provided by the IRS to Congress about non-profit classifications. Here is the exchange:

Not that there wasn't enough evidence to send Lois Lerner to the electric chair before, but she is a Democrat appointee of Bronc-O-Bama so her 1200 get out of jail free cards must be burned one at a time. 

And McCain? He, I think, sees the world through a get-even entitlement  prism that trumps any integrity he may have once had. To wit:  Why did he get so riled at the Swiftboaters who exposed Kerry as the liar and phony that he is?  Because there are a cadre of his fellow Hanoi Hilton POW who claim that he collaborated with his Vietnamese captors. So he saddled up with Kerry because either he felt: that

   1.   Kerry was being victimized by the same ilk of jealous liars, or
   2.   out of some psychological need to aid other phony heroes in order to protect the elaborate wall of denial he's built. 

Either way, he's flawed.  And because so many Conservatives (people valuing integrity he so lacks) have, over the years, pointed out his massive flip-floppery, and worked so hard to deny his nomination for president, we are become in his eyes just more Hanoi Hilton people who need carpet bombing.  That's what I see.

Three weeks after the oft-cited TheFederalist.com accused a popular scientist of making up quotes and numbers in a speech, Wikipedia has moved to eliminate the conservative news site.

“The science-loving censors at Wikipedia, not content with memory-holing unassailable facts about Neil Tyson’s history of fabricating quotes, are now trying to completely erase the Federalist from Wikipedia”
In a surprise move, the hugely-trafficked Wikipedia posted a notice that the Federalist was “being considered for deletion” after an unknown critic said it “does not pass the threshold for notability.” Wikipedia asked users to comment on the decision, though it in the end it will not be made on a “majority vote.”

The claim shocked the new site’s staff, especially since the Federalist has been featured in mainstream media such as MSNBC and CNN.

The website is blaming the attack on its credibility for its criticism of astrophysicist Neil deGrasse Tyson earlier this month. Armed with photographs of a recent Tyson presentation in Seattle, the site accused him of a “habit of using bad math and fabricated quotes in his presentations.”

Now, they said that Wikipedia is retaliating. [Full]

'There's an attempt to marginalize people who hold views that are sharply different'


“We must also concern ourselves with the continued danger we face from individuals within our own borders who may be motivated by a variety of other causes from anti-government animus to racial prejudice,” Holder said.
The Justice Department is resurrecting a program designed to thwart domestic threats to the United States, and Attorney General Eric Holder says those threats include individuals the government deems anti-government or racially prejudiced.

The Domestic Terrorism Executive Committee was created in the wake of the 1995 Oklahoma City bombing but was scrapped soon after the 2001 terrorist attacks as intelligence and law enforcement officials shifted their focus to threats from outside the country. The committee will be comprised of figures from the FBI, the National Security Division of the Justice Department and the Attorney General’s Advisory Committee.

In his statement announcing the return of the committee, Holder said he remains concerned about the specter of attacks prompted by Islamic extremists, but he said this committee will be tasked with identifying other threats.

“We must also concern ourselves with the continued danger we face from individuals within our own borders who may be motivated by a variety of other causes from anti-government animus to racial prejudice,” Holder said.

According to reporting from Reuters, the American Civil Liberties Union is pushing back against the DOJ plan, fearing “it could be a sweeping mandate to monitor and collect controversial speech.”

Conservative groups are alarmed on multiple levels. First, they see themselves once again the target of an administration that disagrees with them philosophically.

“It appears there’s an attempt to marginalize people who hold views that are sharply different from those of the administration and much of the establishment, said Horace Cooper, co-chairman of the Project 21 National Advisory Board. Project 21 is a network of black conservatives.

Santa Clara County, Calif., officials have banned a 20-year employee from making “less than positive” remarks about Obamacare, because they can cause stress for listening co-workers.

The county made the stunning move when Norina Mooney was chatting with a co-worker about the Affordable Care Act,  according to the Pacific Justice Institute, which is representing the woman.

Santa Clara County must have missed this.

The five-year member of the LA Fitness club on El Norte Parkway in Escondido was outraged last week when she went to turn on the right-leaning cable channel while working out and found it wouldn't come in.

Lowe talked to a gym attendant, who she said told her that LA Fitness officials had ordered it shut down.

This month Tennessee amended an anti-harassment law to make it a crime to “communicate with another person or transmit or display an image in a manner in which there is a reasonable expectation that the image will be viewed by the victim without legitimate purpose.” The law applies to any communications including posts to social networks or personal web pages which are essentially public forums. It covers not only posts “with the malicious intent to frighten, intimidate or cause emotional distress” but also to anything that the poster “knows, or reasonably should know, would frighten, intimidate or cause emotional distress to a similarly situated person of reasonable sensibilities.”

To prove a crime has been committed simply requires that someone viewing a post claim they were "frightened, intimidated or emotionally distressed by it. [Full]

Offensive (I hope) Kagan Parody

I remember being in (it was Tennessee Eugene)  one day, ca. 1990, when the local hot topic of debate was a bill making the thrashing of a flag burner a misdemeanor carrying no civil liability and a $5.00 fine. The bill did not pass.

For several years Blogger automatically displayed a header on all blogs that invited anyone to click "Report offensive material."  I was able to avoid being reported several times a day by ratbastard democrat.commers by using third-party code to remove the  invitation. .

These examples were at the time anomalies; today they're trends.  I can't cite names, but over the past few years more than a few congressional Democrats have suggested, attempted to, or otherwise endorsed legislation that would criminalize content they deemed  offensive.

Kootenai County sheriff's deputies told Mark Eliseuson Wednesday that he could be charged with a crime because the 10-foot-tall snowman was holding what appeared to be a noose. Deputies were called by neighbors who were appalled by the pointy-headed snowman with two dark eyes.
The guy is a supposedly a "White separatist," so duh.  We all have our crosses to bear.  As bad as white separatists are, and they're despicable,  this solution is way worse.

Where: Palm Beach State College, Lake Worth, FL
  1. Christina Beattie had received prior permission from college administrator Olivia Ford-Morris to promote her organization - Young Americans for Freedom (YAF) - on campus during "club rush."
  2. On the day of club rush,  Ms. Ford-Morris approaced the group's table, and was visibly disturbed by the material presented --  published by the Heritage Foundation, and criticizing President Obama’s administration. She called the campus police to assure the group left campus.
  3. Ms. Ford-Morris denied giving permission to the organization to be a part of PBSC club rush.
  4. Christina Beattie asserted, “I was shocked and offended by her dishonesty. She outright denied giving me permission to table at Club Rush simply because she disagreed with my beliefs!
The Discussion

Ms. Johnson:
Okay class, somebody here is lying, and it's Ms. Ford-Morris! 
How is it we can make that assertion, with 100% certainty,  knowing only the facts presented?  Any one? Yes, Carl?

The reason we know with certainty that  Olivia Ford-Morris is lying,  is she acted  only after learning that Ms. Beattie's group was conservative.  By her actions she  exposed herself as a liberal, since only they --  Stephanie,  you were real close here -  only liberals are in the habit of stifling free speech to protect their ideology.  People so engaged are base, and not to be trusted in any circumstance.  Take that to the bank.  Yes Bill?
