OK, so by now most of us have heard at least part of the news story about the student Ohio State in Columbus who drove his car into a crowd on the college campus, and then got out and started stabbing and slashing people until he was shot dead by a local cop.

Since the news reports at first seemed hesitant to release his name or description, one could almost have forecast that, when those details were made public, he would be black or Muslim, as those are two groups the Mainstream Media tends to protect and defend. It turns out he was both

But now that he's been identified, expect to hear that "Since he wasn't yelling 'Allahu Akhbar', authorities have no reason to believe this was in any way connected to Islam, the Religion of Peace™."

But I don't think we're going to hear much from Black Lives Matter about how he was "another black man gunned down by a racist white cop who declared himself judge and jury."

And, in all seriousness, are we going to hear anything about the reports that someone pulled a fire alarm just before the car-and-knife attack? That would have resulted in more people out on the sidewalk, providing a more "target-rich environment"; it might also indicate that the attacker had an accomplice. There are also police and witness accounts which mention a second and possibly third person involved. But I'm sure we'll instead be hearing that he was "a lone wolf" who "had been dealing with emotional issues".

It couldn't possibly be anything he'd read in the Most Holy Koran™ or heard in a mosque that made him want to go out and "slay the infidel wherever you may find him."

Actually, it has been reported that the attacker had posted on social media about his unhappiness with the way Muslims were perceived and treated; for example, he was upset that prayer rooms hadn't been provided. Well, his actions will certainly go a long way toward making people reconsider their attitudes toward Muslims, won't they?

I’ve been teaching and studying the U.S. Constitution for a quarter-century, and events have sometimes tugged at my procedural head and my substantive heart in different directions.

The impeachment of Bill Clinton, for example, struck me as a ludicrous comic-opera coup d’etat—

The Constitution is not, however, as Justice Robert Jackson once famously wrote, “a suicide pact.” That phrase is usually used to suggest that government can legitimately overstep its bounds in times of emergency. But it also refers, I think, to moments when “we the people” pour a national libation of Kool-Aid and demand that everybody drink.

I won’t.

The election of Donald Trump was, in procedural terms, scrupulously fair. I hold no dark suspicions of altered vote counts or intimidation at the polls. We may wish the Voting Rights Act had not been gutted by the Court; but the election of 2016 followed the law of 2016.  Clearly a large proportion of American citizens—not as many as voted for Hillary Clinton, but still, under our strange system, enough—wanted Trump as their president and now hope that he fulfills the loud promises he repeatedly made to the country.

But those promises are the problem. Donald Trump ran on a platform of relentless, thoroughgoing rejection of the Constitution itself (?), and its underlying principle of democratic self-government and individual rights. True, he never endorsed quartering of troops in private homes in time of peace, but aside from that there is hardly a provision of the Bill of Rights or later amendments he did not explicitly promise to override, from First Amendment freedom of the press and of religion to Fourth Amendment freedom from “unreasonable searches and seizures” to Sixth Amendment right to counsel to Fourteenth Amendment birthright citizenship and Equal Protection and Fifteenth Amendment voting rights. (so?)

I deny their right to give Trump my rights or those of others who cannot defend themselves. No result is legitimate that threatens the Constitution its very promise of the “blessings of liberty.” No transient plurality, no matter how angry, has the power to strip minorities of equal status and protection; no mass of voters, no matter how frightened, has the power to vote away the democratic future of their children and their children’s children. (HUH?)

American national leaders gain their legitimacy by competing in compliance with not merely the outward forms but the clear values of our Constitution—equal dignity, religious freedom and tolerance, open deliberation, and the rule of law. These values don’t bind Donald Trump; norms of decency do not apply; he shrugs off the very burden of fact itself.

Like dictators of the Old World, he uses his mass media power to lie, to insult, to strip individuals of their dignity, to commit the grossest libels of religious and national groups, and to encourage persecution, torture, and public violence. But I know this as well: Trump was elected President on November 8.

Your Friendly Neighborhood Propaganda Identifiation Service Since 2016!), which claims that millions of Americans have been deceived this year in a massive Russian “misinformation campaign.”

The group’s list of Russian disinformation outlets includes WikiLeaks and the Drudge Report, as well as Clinton-critical left-wing websites such as Truthout, Black Agenda Report, Truthdig, and Naked Capitalism, as well as libertarian venues such as Antiwar.com and the Ron Paul Institute.

The group promoted by the Post thus embodies the toxic essence of Joseph McCarthy, but without the courage to attach individual names to the blacklist. Echoing the Wisconsin senator, the group refers to its lengthy collection of sites spouting Russian propaganda as “The List.”

Well met; however the rather gratuitous slam "The group promoted by the Post thus embodies the toxic essence of Joseph McCarthy, but without the courage to attach individual names to the blacklist" comment caused me to find out that, as expected, author Glenn Edward Greenwald was born in 1967, and thus the product of an education system that, rather purposefully, pedals the "toxic essence of Joseph McCarthy" crap.  

As for the WaPost, it has under the Jeff Bezos encroachment become left wing toxic.

I didn’t realize how many Americans actually hate their own country until I talked about Fidel Castro at Harvard Law School. I had no idea how many Americans despise democracy and have no problem with tyranny – so long as they’re in charge – until I talked about Castro in Manhattan. And I had no clue how many Americans believed that sins committed in the name of socialism weren’t sins at all until I talked about Castro in Ithaca, New York.

Indeed, these early conversations about Castro – and his mass murdering friend, Che Guevara – helped teach my younger self that there was indeed a difference between “liberals” and the radical Left. Liberals are people a lot like me. We broadly share many of the same goals, including a shared interest in greater American prosperity and power. We love this country. During the Cold War, we shared opposition to the Soviet Union. Our policy disagreements are important, but we still share a common bond.

There was no political bond with the radicals I met in law school. They liked Castro because he was a communist. They loved him for his opposition to American power. They were completely indifferent to the suffering he inflicted on dissidents. These people, after all, were likely American spies and dupes, to be treated with all the contempt they deserved.

Radicals exist in every political movement. What troubled me about the people I talked to in Cambridge and New York wasn’t their existence but rather their power. Ivy League professors can dominate their disciplines. Young Harvard radicals often move on to jobs at the pinnacles of American culture and politics. It’s hard to call someone fringe – or to dismiss their views as inconsequential – when they occupy the most coveted positions in the American academy. Indeed, their views were often more welcome than those of orthodox Christians. People like me were narrow-minded and bigoted. My socialist classmates, by contrast, were exactly the “critical thinkers” many of my professors liked to engage.

In the 60's, the Maryland legislature threatened the University of Maryland with financial penalties if the school went ahead with plans to fete communist radical Angela Davis.  She was immediately disinvited.  Ahem. By the 1970's, sufficient numbers of anti-Vietnam radicals were tenured, so she was reinvited.  The Md legislature were silent. Things have gone way south since. So there's that.

The desperate flailing of a mainstream-media struggling through the five stages of grief continues as no lesser unbiased foundation of the fourth estate than The Washington Post pushes ahead with its "fake news, blame the Russians" narrative for why their candidate failed so miserably.

The creation of the Electoral College was certainly part political pragmatism. The proponents of the proposed Constitution wanted a way to reassure skeptical states that their voices would be preserved in a system with a strong federal government. Having states, not the nation as a whole, choose the president was a reassurance.

But it was also philosophical, as the Federalists were eager to avoid rule of the mob and demagoguery. As resentful as they were of the aloof tyranny of George III and the British nobility, the American patriots were, if anything, more alarmed by the prospect of the tyranny of the masses.

Remember, Russia is a democracy. Iran is a democracy. America is a republic.



As Hillary Clinton’s lead in the popular vote stretches out to 1.5 points and may grow more with ballots still being counted in California, the sour grapes caucus in the Democratic Party is getting louder.

This is the fourth time in history that Democrats have won the popular vote but lost in the Electoral College. And this one is shaping up to be the widest discrepancy since 1876 when just one elector and the threat of renewed civil war stood between Republican Rutherford Hayes and Democrat Samuel Tilden.

What’s that you say? The Electoral College is undemocratic? Well, yeah. That’s the point.
Pressure is growing on members of the Electoral College to refuse to vote for the winners of their states. Given Donald Trump’s 74-vote lead in the Electoral College based on state returns, the effort seems to be a symbolic one at best.

More tantalizing for Democrats though, is the claim from “top computer scientists” that they see evidence of electronic ballot rigging in Wisconsin, Michigan and Pennsylvania. The fact that the experts made their case to the remnants of Clinton’s campaign that she dispute the official election results has allowed some embittered supporters of Clinton to remain in denial about the actual result.

But as data dervish Nate Silver explained Tuesday night on Twitter, the computer guys might have benefitted from some practical knowledge of politics. The claims don’t bear even modest scrutiny once you take into account the composition of the counties in question.

Part of the problem here, of course, is that many Democrats believed their nominee’s campaign rhetoric that Trump’s election would bring about the apocalypse. Here, some Democrats have fallen into the same trap that led Republicans, including the now president-elect, to search for conspiracy theories and loopholes to invalidate the Obama presidency all the way through his first term.*

Here's the scoop. Executive summary: It's just the same old sales tax deduction that you've been able to take in place of a state and local income tax deduction, for ten years now. The only thing that's "new" about it is that it became permanent last fall, instead of something that Congress had to extend on a year-by-year basis.

I don't know how the "Oxford Club" hopes to benefit here, but *sigh*, I can hear my tax accountant saying "You Dumb Dick."
