Time Bomb?
Indeed, but not the way Will thinks.

Actual problem#1

The initial reaction by many stunned conservative to the court decision that upheld Obamacare was— Roberts is a genius!"  He was of course nothing of the sort.  Anecdotal evidence suggests that his decision was more a slap at Justice Scalia, because he pushed too hard for calling find the entire law unconstitutional. Which it obviously is.   So, instead of casting his lot with the four justices who, as a rule live within the written constitution they are sworn to uphold, Roberts went with the four, two of them appointed by Obama, who almost never stay in bounds.

George Will here revisits the genius tract, writing The time bomb in Obamacare?   Have at it, but here's the part that really grabbed me.

“ This did not, however, doom the ACA because Roberts invoked what Lambert calls “a longstanding interpretive canon that calls for the court, if possible, to interpret statutes in a way that preserves their constitutionality.” Roberts did this by ruling that what Congress called a “penalty” for not obeying the mandate was really a tax on noncompliance.
”

I don't know where this longstanding canon came from, but the Warren Court sounds about right.  This "canon" then explains why the court NEVER flat-out slams the door on anything.

In the end, Will leaves his readers with another quaint notion.

“ Republicans will ferociously resist exacerbating the nation’s financial crisis in order to rescue the ACA.
”

Sure they will.

The Second Bowel Movement?

The Second Coming ... but, of what?

“
What can I say? Something that this Newsweak "The Second Coming" article does say— about Evan Thomas— is he still can't find gainful employment with any pulp still being published (outside of by some lefty blog).

I seriously think that after Drudge somehow got into Newsweek's computer in 1998, found his  embargoed Monica Lewinsky shocker, and scooped him big time!— I seriously believe he began a journey  into insanity.  He's arrived.

Something I must now reconsider is Obama's "666" credentials.  In 2010 I expressed my feeling that he fell short of expectations, but now?  If there is an anti-Christ, it very well could be he, leaving the likes of Stalin, Lenin and Hitler as  mere archangels of this dark presence. Bill Clinton is still the anti-Christ's John the Baptist.  (Only Jesuits understand any of this).

 New York-Style Pizza at Home

 degRes Ipsa Loquitor

I tried this a few weeks ago, but screwed up a few things.  This time I got it perfect.  It really is on a par with the very best pizza I've ever had.  I love love love the sauce; MoSup thought it a but too acidic but she's getting old (her 47th - I think - oops) birthday today) Still she did agree that this is the best crust ever. You can see the video and get the recipe here; however,  as often happens (I've found), written recipes often leave out a detail, like drain liquid from the whole tomatoes.  In the event you can't log onto ATK, you can find the recipe here.

Additional notes:

  • 2. Add oil and salt to dough and process until dough forms satiny, sticky ball that clears sides of workbowl, 30 to 60 seconds. Remove dough from bowl and knead briefly on lightly oiled countertop until smooth, about 1 minute. Shape dough into tight ball and place in large, lightly oiled bowl. Cover tightly with plastic wrap and refrigerate for at least 24 hours and up to 3 days. (After experimenting, I find that3 days is the optimum).

  • 3. FOR THE SAUCE: Process all ingredients in food processor until smooth, about 30 seconds. Transfer to medium bowl or container and refrigerate until ready to use. NOTE:  The video makes it clear to drain liquid from the tomatoes, this text omits that)

  • Slide pizza carefully onto stone and bake until crust is well browned and cheese is bubbly and beginning to brown, 10 to 12 minutes, rotating pizza halfway through. Remove pizza and place on wire rack for 5 minutes before slicing and serving. Repeat step 5 to shape, top, and bake second pizza. (Note- I put a pan of already boiling water in with the pizza to good effect),
  • I don't have a pizza stone; I used instead a heavy metal baking sheet that I preheated at 550° for one hour.  Worked fine.

Last night, a feller asked me:
Why would you need more than seven rounds in a magazine?
(Well, it was actually “bullets in a clip,” but we’ll overlook that ignorant faux pas.)

My answer was shorter, but this would’a been the long version:
Wellp, that depends …

• Do I have additional magazines at hand? Will I have time to reload?
(It takes me 2sec to reload from a pouch, 5sec standing from a loose pocket.)
• What weapon and ammo am I using?
(Lower-power cartridges require more hits to stop an attack.)
• How good of a shot am I under pressure?
(The range ain’t “pressure.” Do I have any real-world experience?)
• What is the ambient visibility?
(Can’t hit effectively, if I can’t see clearly: darkness, smoke, light in eyes, etc.)
• What is my physioloical situation?
(Glasses off, contacts out? Sweat? Sleeping pill? Flu? Had a few drinks? Wounded?)
• What is my psychological situation? (But wait, there's more Doug...)

Fast & Furious Kills Again

A Fast and Furious gun found at the murder scene of Mexican beauty queen Maria Susana Flores, appears to have been purchased by embattled ATF supervisor George Gillett. Flores was used as a human shield before she was shot and killed by Mexican cartels during a shootout with the Mexican military. According to documents obtained by Senator Chuck Grassley, it appears Gillett purchased a number of different firearms at a gun dealership in Phoenix as part of Operation Fast...  [Full]

The irony that is Obama's  Fast & Furious malfeasance, versus Obama's move to ban semiautomatic hunting rifles—citing as justification a crime that did not involve any— is simply too too.

“I think he wants people to snap."

 Provoking Unrest
HELTER SKELTER

“

"Coming on the heels of a recent birth-control mandate, Limbaugh noted, “All of this is so in our face. Everything that people hold dear is under assault. Deliberately making people upset. This is not what presidents do.” [Full]

PALM BEACH, Fla. – President Obama’s newly announced gun-control initiatives are intended as “revenge” against many Americans, as he’s pushing them “to snap,” claims top-rated radio host Rush Limbaugh.

“I think he wants people to snap. I think Obama is challenging everybody’s sanity,” Limbaugh said on his show Wednesday afternoon. “Obama [is] literally pushing people to snap, attacking the very sanity of the country.”

For the past few years I've been convinced that the only explanation for Obama's bizarre, "in your face," very confrontational behavior  is a  purposeful attempt to crate a Helter Skelter scenario.  It would give him the opportunity to impose martial law, suspend all civil liberties.  And— yes boys and girls— finally convince even the most ardent useful idiots that they have  miscalculated. Mammouthly, stupendously and outrageously miscalculated. .  It appears Rushbo sees it too.

Any crisis plays into his hands, so there's basically nothing we can do about it.  Before the Newtown shootings I entertained the notion that the Obamas are not beneath manufacturing their own "Gleiwitz incident."  Well, they don't have to.  As Rahm Emanuel noted, "You never want a serious crisis to go to waste,"  What's a serious crisis?  Any damned thing the media choose to put legs onto.  Whatever it is, it will happen.

What's the worst thing I can do to this poseur?
I'm limited to doing war propaganda posters. It's like shouting crude epithets at the stupid driver in front of you; some of us need a steam valve.  But dear God,  I do hope people don't lose their senses and storm the White House, and the Naval Observatory grounds and Senate office buildings.  That would be very naughty. And unlawful.

I almost forgot   Early in the week MoSup heard on the radio what cuzzin Ricky has just now reported, FWIW. I couldn't find any mention of it. so passed.  If this is true, will it matter?  Will the media retract and apologize.  Plllt.  Still, what's important about this nugget is that 'it could be true.' Anyone capable of a Benghazi or a Gunwalker (or a "Gleiwitz") will do anything.

"Passing this on from a friend of mine..... yep, sounds very bizarre and conspiracy theorist......BUT, please make sure you hit and view the NBC News link. Unless the story was updated, it turns out that the AR15 (military assault-style weapon) the shooter had at Sandy Hook, wasn't even used in the event...he left it in his car!

Given that hypocrisy is an important part of diplomacy, and diplomacy is necessary to foreign policy, allow me to congratulate you on your reelection.

I wish I could also congratulate you on your conduct of international affairs. I do thank you for killing Osama bin Laden. It was a creditable action for which you deserve some of the credit you’ve been given.

But the worst thing that you’ve done internationally is what you’ve done domestically. You sent a message to America in your reelection campaign. Therefore you sent a message to the world. The message is that we live in a zero-sum universe.
Of course the intelligence was gathered, and the mission was undertaken, by men and women who, although they answer to your command, answer to duty first. And it’s difficult to imagine any president of the United States who, under the circumstances, wouldn’t have ordered the strike against bin Laden. Although there is Jimmy Carter. Thank you for not being Jimmy Carter.

But even though it violates the insincere amity that creates a period of calm following national elections, no thank you for the following, and it is only a partial list: [P.J. Continued]

The other funniest thing I heard yesterday is that  New York Gov. Cuomo Jr. is positioning himself for the 2016 elections even further left than Obama and Hillary.  It seems he has found the portal into some nether world.

The St. Paul Pioneer Press reports that on January 10, the Minnesota Supreme Court suspended attorney Thomas P. Lowe from the practice of law for having an affair with a client and subsequently billing her for sex.

Lowe’s suspension will extend for at least 15 months.

For those who've seen this tool chest on Deals Woot (it's appeared 3-4 times) and wondered what you get for $79, it's this.  It arrived pretty much assembled, only had to put the wheels on.  I'm damned impressed.  No, it's not close to being as sturdy as Craftsman's pro models, but then you don't have to pay hundreds of dollars.  It is what it is, and I like it.  Hell, if you're food-stamps poor, use this for your TV stand, and store your cables and stuff, and "those" special tapes in the lockable drawers.  *wink wink*.

Yes, He Deserves Impeachment

Strokes of the Pen

“

If ever a president deserved impeachment, it's this guy.  I want to focus on Executive Orders here, because after 15 years of trying to make sense of this presidential prerogative, I am still left with too much gobbledygook gook.  Consider:

Although there is no constitutional provision or statute that explicitly permits executive orders, there is a vague grant of "executive power" given in Article II, Section 1, Clause 1 of the Constitution, and furthered by the declaration "take Care that the Laws be faithfully executed" made in Article II, Section 3, Clause 5. Most executive orders use these Constitutional reasonings as the authorization allowing for their issuance to be justified as part of the President's sworn duties,[2] the intent being to help direct officers of the U.S. Executive carry out their delegated duties as well as the normal operations of the federal government: the consequence of failing to comply possibly being the removal from office.[3] [Wikipedia]
Ahem;
 Article 2, Section 1, Clause 1

The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows

Res Ipsa LoquitorArticle 2, Section 1, Clause 5

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Technically, these regulations and executive decrees are not “laws” — but they might as well be. Over the past century, Congress has granted so much power to the regulatory agencies that the executive branch, not Congress, now writes the majority of new federal rules, averaging about 70,000 pages of regulations per year. But in a last minute orgy, Clinton’s administration is scheduled to issue about 29,000 pages of new regulations made just in the last three months of his term. " - [Here]

In a nation of 315,165,272 people there must be at least  200,000 who are not lawyers, and I'm one of them.  Which is why I cannot do the mental gymnastics necessary to find where presidents find the power to  legislate via the Executive Order.  Maybe it's in the same box where the courts discovered theirs?

Up until Abraham Lincoln (3), there were few if any orders by Presidents that would classify as legislation. The biggest leap in EO use came from Teddy Roosevelt. Before his presidency there had been a TOTAL 158 uses of the EO.   T.R.  issued 1,006!  Wilson had  1,791; FDR  3,723 (over 12+ years and a World War).

It's not really the number of Ex-Orders issued, although to me they're all extra constitutional, and outside of the framer's intent.  It's the degree of maliciousness that really counts.  For instance, Bill Clinton actually issued 364 E.O., but they actually numbered in the thousands, thanks to what regulatory agencies did with them. Coal-Gate was one of his most  outrageous.

" When the president signed the Executive Order designating 1.7 million acres of land in southwest Utah as the Grand Staircase-Escalante National Monument, his action placed the area off limits to mineral extraction and development. The New York Times reported that the monument encloses the largest coal field in the nation, the Kaiparowitz Plateau, which contains at least 7 billion tons of coal worth over $1 TRILLION. "

He did this without even mentioning it to any of Utah's congressional delegation.  The primary beneficiary?  The Lippo Group, which Clinton was highly indebted to.  Stroke of the Pen!

Obama has been testing what he could get away with since he took office.  Stopping the deportation of illegals, which directly contravene US law, is impeachable. Now, finally, it appears he may be thwarted by threatening to Executive Order the Second Amendment into the trash bin.  But he won't give up.  Obamacare give Democrats the ability to tax anything, or designate anything health hazard.

What's really scary is how congress has gone belly-up to this usurpation of their power.  Traditionally congress goes bat-shat over any Executive Branch meddling, but not now.  Not by the Senate, especially.  Both Harry Reid and Nancy Pelosi have urged Obama to use E.O/ powers to get what they cannot pass legislatively.  That's how evil they, and their intentions are. And what makes me believe that Obama was " purpose built."

Gives you the warm fuzzies don't it?

Chicago’s illustrious Police Chief, Superintendent or SuperNintendo ... said that citizens licensed to carry could be, and indeed predicted they would be shot by Chicago Police Officers.

Like that happens in 49 other states (or 56 other states if you listen to Barack Obama).

“I don’t care if they’re licensed legal firearms, people who are not highly trained… putting guns in their hands is a recipe for disaster. So I’ll train our officers that there is a concealed carry law, but when somebody turns with a firearm in their hand the officer does not have an obligation to wait to get shot to return fire and we’re going to have tragedies as a result of that. I’m telling you right up front.” [Full]

Is McCarthy the only big city chief of police that's not Black or female?  Just asking.  Anyway, Chicago's top cop immediately reminded me of this restaurant scene from  The Godfather .  Love the ending. Sic Semper, etc.

On the subject of Democrats and guns, did you see NY newspaper’s gun permit disclosure leads to burglary, new legislation?

“ A home burglary in White Plains, N.Y. that appears related to a newspaper’s recent publication of gun-permit holders will bring a legislative response Monday, in the form of a new bill aimed at banning similar public disclosures in the future.
”

The problems with knee jerk legislating  against (anything really) "similar public disclosures,"  are the unintended (or internded?) consequences,  when common sense and decency ought have  prevailed in the first case.

Dragon on Cheats

Using Dragon out of the box and not checking anything

“
Res Ipsa Loquitor
Like millions of cops and other government workers around the world, I guess, I am a hearts officiadano.  Microsoft arts,  and I been playing it for 15 years and what I discovered over that time is that while initially it was quite easy to beat hearts -- I once actually counted 30 straight wins one night before quitting having-- that's how easy it was. Am glad that admittedly was a little bit too easy sell with each update of Windows and seem to get a little harder in the in the way they managed to make it harder was to add cheating and now with Windows 7 tweak it really over the top three to

what Microsoft have done is to under the ruse of saying okay, will allow you to keep track of your cumulative scores a to do had of course Microsoft has to keep a database of your games and how many you want to do interviews as however is to set plateaus are rather limit the number of wins anyone gamers allow that now this may different from person to person I don't know but for me it seems to be around 53% of the time came after hundreds now let's say thousands of new games using Microsoft seven I have been at 50% in the 52% wins for agents and you cannot go over that -- you can go under quite easily but you cannot go over the and the way they do it is to simply cheat and its and it's maddening

(for instance there seems to be various levels level I is "okay we will will play evenhanded" and  if you are on the ball you'll probably win until it suddenly starts to become a threat at that point now off the cheating a bit there was a cheat is they distribute the cards so that each of your three opponents have all his suit on me -- let's say you are playing spades, well after four times of leading spades they they would all be gone but oh no not now because only one person has the remaining spades so you might have six hearts but the diagonal left has seven& that's that's hard to beat if you do manage to beat that however is what they do is say were going to win and they do they don't follow suit they keep track of who's about to go out if you're about to win the game for it since that person will say somebody the area right as 98 point used to from going out right and say you only have 30 it doesn't matter the guy you write will not take any additional points that the card she needs will just be there in other words the cheek to cheek like hell now…

this is increasingly like dealing with our government.  Microsoft for whatever reason is just decided the heck with those rules and that's how our government is. And Congress Center presidency and our governors asked the how this goes right down the line he no doubt even local government they decided they know what they want and they're going to get it doesn't matter what the rules are and if they can change the rules ad hoc they doing this is made very easy with the introduction of regulatory commissions and almost not everything in a regulatory agencies get to make up the rules as they go along there is no single law that list what you can do and can't do it's it's up to some GS four clerk for instance you can make a decision that impacts on millions and millions of Americans in tough luck if you want to complain.

Look at Obama about two years into his presidency I'm thinking he cited and this is really hard get get in this Republican house to pass the legislation I want. And he really wanted it so the way to do it was to use the Executive Order. The Executive Order if you if you go look into its history is one of the one of the damnedest things that find its way into our way of governing that I've ever seen many was initially implemented for president in times of war to make quick decisions to do the required congressional approval that protected the nation and now it's it's degenerated into inbox in Obama's administration bypassing Congress entirely and just as Stephanopoulos when said stroke of the patent law of the land. Think about that. Obama using the Executive Order has the power to become a tyrannical ruler and worse than having the power he also has a disposition so where flocked and I dictated all this and my family, Dragon.

I have even spellcheck the same looked at it I just rambled on and so what you have here is how I think muddled up and with hers and eyes and but you I think can see what I'm talking about one final thing damn you Seattle Seahawks.

Hatch on Guns

                      croak ?

"To preserve liberty, it is essential that the whole body of the people always possess arms, and be taught alike, especially when young, how to use them." (Richard Henry Lee, Virginia delegate to the Continental Congress, initiator of the Declaration of Independence, and member of the first Senate, which passed the Bill
of Rights.)

Samuel Adams, a handgun owner who pressed for an amendment stating that the "Constitution shall never be construed . . . to prevent the people of the United States who are peaceable citizens from keeping their own arms," would be shocked to hear that his native state today imposes a year's sentence, without probation or parole, for carrying a firearm without a police permit..
"The great object is that every man be armed . . . Everyone who is able may have a gun."(Patrick Henry, in the Virginia Convention on the ratification of the Constitution.)

"The advantage of being armed . . . the Americans possess over the people of all other nations . . . Notwithstanding the military establishments in the several Kingdoms of Europe, which are carried as far as the public resources will bear, the governments are afraid to trust the people with arms."
(James Madison, author of the Bill of Rights, in his Federalist Paper No. 26.)

The proposal finally passed the House in its present form: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.:" In this form it was submitted into the Senate, which passed it the following day. The Senate in the process indicated its intent that the right be an individual one, for private purposes, by rejecting an amendment which would have limited the keeping and bearing of arms to bearing "For the common defense".
"There can be little doubt from this that when the Congress and the people spoke of a "militia", they
had reference to the traditional concept of the entire populace capable of bearing arms, and not to
any formal group such as what is today called the National Guard. The purpose was to create an
armed citizenry...  considered essential to ward off tyranny.
"

This content from Orrin Hatch's preface to a 1982 Senate Judiciary report on the THE RIGHT TO KEEP AND BEAR ARMS.  I think this a fine stand alone source document for anyone (pro or con) thinking about whys and wherefores of the Second Amendment.  Sadly, and I do mean sadly, we have entered an era where government leaders, including the Judiciary, simply do not care what the Superstition's and Bill of Rights demand of them.  Screw them; the founding documents are still the bible of the free people we are, barely still. Which is what the Second Amendment exists.
.                                                                A timely reminder from R.W. Forsythe
